Securities Markets Act 1988, nor is it operating a market that is
regulated under New Zealand law. Yieldbroker does not offer trading or
operate a market in relation to futures trading for contracts regulated

| Yieldbroker does not provide any legal, tax, accounting, securities or investment advice in connection with the securities referred to on the System whatsoever. Yieldbroker is under no obligation to update or correct any information. | |
| Disclaimer of Responsibility | |
| Subject only to your rights as a consumer (set out
below), you agree that none of Yieldbroker and the Dealers will be
liable in any way for any direct or indirect loss or damage arising from
or occasioned by: (a) any inaccuracy or omission from any information or your reliance on information provided on the System or the Dealers’ Systems; (b) any non-performance, including failure or malfunction in the operation of the System or the Dealers’ Systems; or (c) any interference or interruption with, or delay in, the provision of accurate information, including any negligent act or omission by Yieldbroker or the Dealers or any other cause beyond the reasonable control of Yieldbroker or the Dealers. Yieldbroker does not guarantee the obligations or performance of the Dealers. Neither the Dealers nor the shareholders of Yieldbroker guarantee the performance of Yieldbroker. The liability of Yieldbroker and the Dealers for loss or damage of any kind (including loss or damage caused by negligence or breach of contract) is reduced to the extent that you contributed to the loss or damage. |

| Consumer rights | |
| Notwithstanding the disclaimers and exclusions above, if anything arising out of or connected with this agreement constitutes a supply of services to a consumer, then you may have the benefit of certain rights and remedies pursuant to the Trade Practices Act 1974 (Cth) or the Australian Securities and Investments Commission Act 1989 (Cth) and similar state and territory laws in Australia, or the Consumer Guarantees Act in New Zealand, in respect of which liability may not be excluded or restricted. Nothing in this agreement will exclude or restrict such non-excludable rights or remedies. Insofar as such liability may not be excluded, then to the maximum extent permitted by law, such liability is limited, at Yieldbroker’s exclusive option, to (a) resupply of the services; or (b) payment of the cost of having the services supplied again. | |
| Unauthorised use or duplication | |
| Information may be printed or downloaded by an Authorised User for their internal use only and Yieldbroker otherwise expressly prohibits the dissemination, reproduction or transmission of the contents in any form without the prior written consent of Yieldbroker. Any unauthorised use, duplication or disclosure is prohibited by law and will result in prosecution. | |
